1. Agreement

Chimney Cleaning is owned and operated by Lead Indicator LLC ("we", "us", "our"). These Terms of Use govern your use of this website. By using this website or submitting a request, you accept these terms. If you do not agree, do not use the site. You must be 18 or older to use it.

2. What this service is

Chimney Cleaning is a free referral service that connects homeowners with independent chimney cleaning contractors. We are not a contractor. We do not perform any work and do not employ the contractors we refer you to. We do not guarantee that any work will be done, or any contractor's licensing, insurance, quality, pricing or availability, or that we will find a match for your request. You are responsible for checking a contractor's licenses, insurance and references before hiring them. Any agreement for work is solely between you and the contractor.

3. Consent to be contacted

When you submit our form you agree to the following: "By clicking the submit button, I agree to the Chimney Cleaning Terms of Use and Privacy Policy, and I give my express written consent for Chimney Cleaning (operated by Lead Indicator LLC) and the chimney cleaning contractor matched to my request to contact me about my request at the phone number and email I provided, including by calls, texts, and prerecorded or artificial voice messages, which may use automated technology. Consent is not a condition of any purchase. Message and data rates may apply; message frequency varies. Reply STOP to opt out of texts. I confirm I am 18 or older and the owner or authorized user of this phone number."

You can withdraw this consent at any time by replying STOP to any text message, using our opt-out page, or emailing support@leadindicator.ai.

4. Your obligations

• Give accurate, current information about yourself and your project.
• Only give a phone number that you own or are authorized to use, and an email address that is yours.
• Do not submit a request on behalf of someone else without their permission.

5. Disclaimers, limits on liability, and indemnification

The site and the service are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. To the fullest extent the law allows, we and Lead Indicator LLC are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from work done or not done by a contractor, and our total liability for any claim relating to the site or the service will not exceed $100.

You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable attorneys' fees) arising from your use of the site, the information you submit, or your breach of these terms.

6. Third-party sites and contractors

The site may link to other websites, and contractors are independent third parties. We are not responsible for their content, services, products, statements or conduct.

7. Intellectual property and prohibited uses

The site and its content belong to us or our licensors and are protected by law. You may not copy, scrape, crawl or harvest the site or its data by automated means; submit false, fraudulent or test requests; submit information about another person without their consent; interfere with the site's operation or security; or use the site for any unlawful purpose.

8. Arbitration and class action waiver

Please read this section carefully. It affects your legal rights. You and we agree to resolve any dispute arising from or relating to these terms, the site or the service by binding individual arbitration, rather than in court, except that either of us may bring an individual claim in small-claims court. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules and held in Henrico, Virginia, or by video or telephone if you prefer.

Class action waiver. Disputes will be resolved only on an individual basis. You and we waive any right to bring or take part in a class, collective or representative action or arbitration.

Opting out. You may opt out of this arbitration agreement by emailing support@leadindicator.ai within 30 days after you first accept these terms, with your name, phone number and a clear statement that you are opting out of arbitration.

Governing law. These terms are governed by the laws of the State of Virginia and applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules.

9. Changes, severability and contact

We may change these terms; the effective date at the top shows when they last changed, and using the site after a change means you accept it. If any part of these terms is found unenforceable, the rest stays in effect.
